The next step in the lawsuit filed by the Butler Area School District against Governor Tom Wolf and the Secretaries of Health and Education is scheduled for next month.
Oral arguments will begin the morning of June 9th. The school board approved the lawsuit filed by local attorney Tom King last year with regard to the attestation form that was imposed upon districts.
The attestation form set out guidelines specific for how schools should operate when COVID cases are confirmed inside their buildings. The Butler school board signed the form under protest but does not believe this action is within Wolf’s power under the emergency powers act.
The lawsuit will be heard by the state’s Commonwealth Court in Harrisburg and be paid for using money from the Butler Area School District’s legal fund.
