A statewide court has reversed a ruling that now allows voters to cast a provisional ballot if they make a mistake on their mail-in ballot.
The Commonwealth Court ruled that the Butler County Elections Office should have counted the two provisional ballots after the original mail in ballots were not counted due to missing a secrecy envelope.
The court ruled that the “Election Code, properly construed, does not prohibit counting Electors’ provisional ballots. Accordingly, we reverse the Trial Court’s order and direct the Butler County Board of Elections to count them.”
This lawsuit was filed on behalf of two voters by the ACLU. Since that time it has garnered attention from both Republican and Democrats nationwide.
The Bureau of Elections has three days to appeal the decision to the state’s Supreme Court.
