A hearing was held yesterday in the Butler County courthouse over possession of cash related to a homicide case.
Defense attorneys for 38-year-old Hassan Brack filed a motion to have an undisclosed amount of money returned to him.
Brack is accused of killing 31-year-old Hakeem Morgan during a December 2021 drug deal. He faces charges of murder and robbery for the alleged crime. In April a mistrial was ruled after two days of deliberation led to no verdict.
The motion was filed after a federal investigation into Brack deemed no criminal charges and the investigation was closed. The money was originally taken as part of a criminal investigation.
Attorneys for Brack claim that because the federal investigation has been closed and the money was not found near drugs it should be returned.
While prosecutors claim that money helps prove testimony provided by witnesses.
A total of 13 items were taken including a digital scale, a gun, and several cell phones but the defense is not asking for these items back, just the money.
Judge Timothy McCune did not make a ruling from the bench and no new trial date has been announced for Brack.
