The Pennsylvania Supreme Court has overturned a decision from 1985 that involves the funding of abortions.
The court found that banning the funding of abortions through Medicaid was “presumptively unconstitutional.” Although, the court sent the ruling to a lower court (Commonwealth Court) to have the final say.
The ruling found the 1982 Abortion Control Act discriminates based on sex, which restricted abortions from Medicaid Healthcare providers unless in certain circumstances.
The dissenting Judge Debra Todd, argued that the court must stand by its 1985 unanimous decision.
