Two voters are suing Butler County arguing that their ballots should have been counted in last week’s primary election.
Attorneys for the American Civil Liberties Union, also known as the ACLU, filed the suit on behalf of Faith Genser of Zelienople and Frank Matis of Center Township.
The suit alleges that both voters did not place their mail-in ballot inside the secrecy envelope that is mandated by state law. However, the two voted provisionally at their precinct on Election Day.
The board of elections ultimately decided to not count either ballot. Per the county’s ballot curing policy, if the ballot is sent in without a secrecy envelope, both the mail-in ballot and provisional ballot will not be counted.
Voters can correct mistakes like signatures and incorrect dates.
“We follow election code as written,” County Commissioner Leslie Osche said.
