Former Butler School Board Member Bill Halle was back in court yesterday looking to dismiss the charges leveled against him.
Halle’s attorneys filed a motion to dismiss all four counts of crimes against him, including Sexual Assault by a volunteer or employee of nonprofit.
The defense lawyers argued that the victim was not a participant at the Grace Youth and Family Foundation (GYFF) but an independent contracted employee. The defense claims this because the victim did not fall under the statute of participant written in the law.
The prosecution argued that the victim was involved with the martial arts program at the GYFF via text messages. The defense then argued that the victim may have been part of Halle’s son martial arts organization and questions remained if that was part of the GYFF.
Halle’s lawyers also argued the age of consent in Pennsylvania is 16 not 17 or 18. Which the prosecution argued against but could not provide case examples in the commonwealth that said otherwise.
No word was given on when the judge would make a ruling.
