Republican State Leadership is praising a recent State Supreme Court ruling that warrantless searches by game officials are unconstitutional.
A lawsuit filed by state hunting clubs, challenged two Game and Wildlife Codes that allowed game wardens to enter private land without warrants.
The case stems from a hunter accused of baiting a bear illegally and reporting bagging a bear minutes after the season opened.
The State Supreme Court ruled that due to the lands being possessions the searches were deemed unconstitutional.
The unanimous ruling called these searches unconstitutional and challenged a 1924 U.S. Supreme Court ruling that said the Fourth Amendment did not apply to farmlands or woodlands.
A joined statement Senate Republican leadership said “Every Pennsylvanian deserves to feel safe and secure on their own property, and the Pennsylvania Supreme Court was right to uphold the strong privacy and property protections provided by our state constitution.”
