A hearing date has been scheduled in the case of the man who allegedly hit and killed a teenager in Butler Township.
The hearing will decide if the prosecution has violated 41-year-old Joshua Rivera’s “Rule 600” rights will be held on Tuesday at 10 a.m. at the Butler County Courthouse.
Rivera is accused of hitting and killing 15-year-old Aiden Lutz with his vehicle on Dutchtown Road in October 2023.
Rule 600 guarantees a right to a speedy trial by setting the days between placement in jail and the trial date at 180 days. Earlier this year it was ruled that Rivera had passed the 180-day limit but bail was denied. Defense attorneys are now arguing the 365-day limit has passed and charges must dismiss.
Days are only counted if the prosecution delays scheduling hearings or the trial.
