More legislation is being proposed to limit the power and access of data centers in Pennsylvania.
House Bill 2533, would allow for municipalities to place an 18-month moratorium on data center development as they navigate the impact a center has in a community. This bill is currently in the House Local Government Committee.
The second bill being proposed in the State Senate would ensure that data centers are not listed as utility companies in the Commonwealth.
If data centers were categized as utilities, it would limit local governments authority of these facilities. If data centers are categized as utilities, they would gain eminent domain and be able to take private property for a project that benefits the public.
This bill is seeking co-sponsors and has yet to be introduced.
