A Pennsylvania court has barred the state’s entry into the Regional Greenhouse Gas Initiative.
The Commonwealth Court recently ruled that the effort by the state Department of Environmental Protection and Environmental Quality Board to join the initiative, also known as RGGI, without legislative approval violates the Pennsylvania Constitution.
Following the ruling local State Senator Scott Hutchinson issued a statement regarding the decision and his role as chairman of the Senate Finance Committee:
“No RGGI Tax legislation will be reported from the Senate Finance Committee,” Hutchinson said.
This ruling supports the position of Senate Republicans that joining RGGI would create a tax, which can only be done by legislature.
